Announcing Retail Race - an optional Kickfurther Contest for our users. **Updated 2/6/18**

During the next few weeks, Kickfurther will be launching Retail Race.  Users can earn prizes by participating in the race, and the first user to cross the finish line wins the grand prize.  The grand prize, valued over $50k, is an all expenses paid vacation for two to La Belle Etoile, a beautiful Italian villa with space for up to 16 friends.  If someone wins our grand prize, then a domestic flight to Boulder, Colorado will be given to the subsequent winners. The official rules are listed below and by participating you agree to be bound by these rules.  The contest will be running until August 31, 2017. **Edit - The contest has been extended through 12/31/2018.

The contest will heavily incentivize user participation on Kickfurther. Users will earn the following point values for partaking in the following events:

Users participating in Retail Race can view their point and level status in their Kickfurther user dashboards under “Retail Race."  The Retail Race leaderboard will be hosted here as well to showcase the top 10 users with the most points at any given time.

Contest Vision

We all shop, whether for pleasure or survival because we know what we want when we see it. Humans have been bartering and selling to get what they want since before recorded history. Clothes, food, entertainment; it’s part of our DNA.  Last year alone there were over 5 trillion dollars of retail sales in the US; an estimated two-thirds of the U.S. gross domestic product (GDP) comes from retail consumption. Not to mention the money spent to support retail like financing and marketing costs.  Tools are popping up left and right to make it easier to create an e-commerce brand from scratch: Amazon, Kickstarter, Shopify and Alibaba, but retail is still a scary world. Most of the reason it’s so scary is because you have to enter it alone. You have to risk the time, the money, do all the work yourself and there is no guarantee you’ll make a dime, no wonder people don’t all quit their 9-5’s tomorrow. But you are not alone. Kickfurther and the Brands who list with us know you are more than a passive shopper. You are an individual with resources, knowledge, and connections. You can play the game too, and the community can help.  Team up with fellow Buyers, choose Brands whose products you believe in and whose management you trust. You choose your commitment, but no matter how small you can create value and earn along with everyone else.

  1. Eligibility

            Retail Race (the "Contest") is open to legal residents of the United States (except residents of New York, Florida, Colorado, North Dakota, Maryland, Vermont, Nebraska, and any unincorporated territories of the United States) who are at least eighteen (18) years old at the time of entry. Employees of Ouiby Inc. DBA Kickfurther and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to federal, state, and local laws and regulations. By choosing to participate in the Contest you agree to these Contest Rules.

  1. Sponsor

            The Contest is sponsored by Ouiby Inc., located at 311 Mapleton St. Suite 231

Boulder, CO 80304 (the “Sponsor”).

  1. Agreement to Official Rules

            Participation in the Contest constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. Kickfurther shall have the right to change these rules, the ways to earn points, and the prizes offered at any time and at Kickfurther's sole discretion. Kickfurther is under no obligation to award any prize listed within the Contest and shall always retain a right to refuse to award such prizes at its sole discretion.

  1. Contest Period

            The Contest begins on March 13, 2017 at 6:00 AM MST and ends on December 31, 2018 at 6:00 PM MST MST (the "Contest Period"). Entries that are submitted before or after the Contest Period will be disqualified. 

  1. How to Participate and Prizes

You will earn the following point values for partaking in the following events:

  1. Winner Selection

            Certain Winners will be notified within Fifteen (15) business days after the date they qualify to win prizes other Winners may find certain "virtual prizes" existing in their Kickfurther account upon those Winners qualification to earn such prizes. If a Winner believes they are eligible for a prize they have not received, he or she should contact Kickfurther at contact@kickfuther.com. If Winner fails to receive the prize or contact Kickfurther about such prize within Fifteen (15) business days may result in disqualification and/or selection of an alternate Winner. 

  1. Winner Notification 

            The potential winners will be notified by email, mail or phone. Each potential prize winner may be required to complete, electronically sign and submit a Declaration of Compliance and Release within five (5) days of the date notice or attempted notice is sent, in order to claim his or her prize. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance and Release within the required time period or the prize is returned as undeliverable, the potential winner forfeits prize. If the potential winner is at least 18 but still considered a minor in his or her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his or her parent or legal guardian, who will be required to sign the Declaration of Compliance and Release on the potential winner’s behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Contest.

  1. General Conditions

            In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney's fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

  1. Release and Limitations of Liability

            By participating in the Contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) miscalculation of points, failure to credit points, failure to provide prizes (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, the processing of entries, points, or prizes, typos or misstatements in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney's fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

  1. Disputes

            Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Boulder County, Colorado. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Colorado, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Colorado.

  1. Privacy, License, and Release

            Information collected from entrants is subject to sponsor's privacy policy which can be found here: https://www.kickfurther.com/privacy-policy 

            Kickfurther reserves the right to use any and all information related to the contest, including submissions provided by the contestants, for editorial, marketing and any other purpose, unless prohibited by law.   

            Participants hereby grant Kickfurther a non-exclusive, 5-year, worldwide license to broadcast, publish, store, reproduce, distribute, syndicate, and otherwise use Winner's names and/or likenesses in all media now known and later come into being for purposes of trade or advertising without further compensation. Participants represent and warrant that they have full legal right, power and authority to grant Kickfurther the foregoing license and if applicable, have secured all necessary rights in order to grant such a license.

  1. Winner List

            To request the name of the winner, send a self-addressed, stamped envelope to PO Box #21584 2995 55th St. Boulder, CO 80308-4584. Winner List requests will only be accepted after the promotion end date (listed above). If your state of residency requires the Contest to provide you with a free Winner List by mail, please contact us via mail or email and one will be provided at no cost for you.
